WHO MAY ATTEND?

Folsom Lake College is open to anyone who is a high school graduate (or the equivalent) or who are at least 18 years of age and able to profit from the instruction offered. A completed application with declared residency must be submitted prior to enrolling in classes.

Courses Open to All
Every course, course section, or class offered by the Los Rios Community College District that receives state support is open to you if you have been admitted to the college and meet the course requirements (prerequisites) unless specifically exempted by law, and as may be established to Chapter II, Division 2, Part VI, Title 5 of the California Administrative Code, commencing with Section 51006.

RESIDENCY REQUIREMENTS
Under California State Education Code regulations, students establish residency through the application process.  The burden of proof to clearly demonstrate both physical presence in California and intent to establish California residency lies with the student (Title 5, sections 54000-072).

To be eligible for California residency, you must:

  1. Be a U.S. citizen or hold a U.S. Immigration status that does not prevent establishment of residency. The following visa status holders cannot establish residency regardless of the length of time in California:

          B-1, B-2, C, D-1, D-2, F-1, F-2, H-2, H-3, J-1, J-2, M-1, M-2, O-2, P-1, P-2, P-3, P-4, Q
          and TN/TD. For more information, see the Residency Reclassification Request form.

  1. Verify physical presence in California one year and one day prior to the first day of the semester.
  1. Clearly verify intent to make California a permanent place of residence.

Residency Derived from Spouse or Parents
A man or woman must establish his or her own residency. A person’s residency cannot be derived from that of his or her spouse.

Students under 19 years of age and unmarried may derive California residency from their parents. The student must reside in the parents’ residence. The parents must meet the eligibility requirements and provide required documentation showing the acts of physical presence and intent. Students 19 years of age or older may not derive residency from a parent (except in the event that the student is financially dependent). When a student is financially dependent, the documents submitted must show the dependency of the student AND the California residency of the person the student is dependent on.

Required Documentation for Residency
A minimum of two documents is required to verify both the intent to reside in California and your continuous physical presence in California for one year and a day prior to the start of the semester. Documents submitted must include the student’s name, the student’s California address, and a date at least one year and a day prior to the beginning day of the semester.

Documents which may be used to support your request for California residency status include (but are not limited to):
California Driver's License or ID card
Calfiornia Motor Vehicle registration documentation
California voter registration card
Statements for active California bank accounts
Utility bills (gas, water, power, telephone)
California State Income Tax 540 form with California address (previous years) - as resident
Current W-2 form (showing CA address)
Out-of-state institution non-resident tuition receipt
Documentation of ownership of residential property or of continuous occupancy of rented or leased property in California
Documentation of public assistance, rehabilitation, unemployment or other CA state services
Documentation of active membership in service or social club
Maintaining permanent military address or home of record in California while in Armed Forces

Examples of conduct inconsistent with a claim of California residency:
Maintaining voter registration in another state
Being a petitioner for divorce in another state
Attending an out-of-state institution as a resident in that state
Declaring non-residency for state income tax purposes
Maintaining a driver's license and/or vehicle registration in another state

Exceptions to Residence Requirements
Exceptions to the residency requirements include, but are not limited to the following:
Dependents of active duty military personnel stationed in California *
Active Military personnel stationed in California *
Certain minors who remained in California when their parents moved *
Self-supporting minors *
Full-time employees of college/state agency, or child/spouse of the full-time employee *

*Documentation will be required.

Non-Residents
Students who have not established residency in California for one year and one day prior to the beginning of the term in which they wish to enroll, residents of other states or territories of the United States, and residents of foreign countries must pay nonresident tuition in order to attend FLC.

Non-Immigrant Aliens who are in the USA under a non-immigrant classification such as B, C, D, F, H, J or M cannot gain a resident status since the law relating to him/her provides that he/she is required to maintain a residence in another country and is only allowed to remain in the USA temporarily.

Aliens with B-1, B-2, F, J, and M status may be admitted to the college as full-time students subject to admission to the college’s international student program.

California AB 540: Special exemption from out-of-state tuition
Certain non-residents who have attended a high school (public or private) in California for three or more years AND have graduated from a California high school or attained the equivalent in California prior to the semester may qualify for the AB540 non-resident fee exemption. Students who hold non-immigrant visas (for example, B-1, B-2, F-1, and J) are not eligible.

If you feel you are eligible for this special exemption, please download and complete the AB 540 form and submit to the A&R office along with documentation showing California high school attendance for 3+ years and graduation status.

Petition for Reclassification
Reclassification for Residency petitions are available online or in the A&R office.  Reclassification request forms will be processed within 5-7 working days - and the decision regarding residency status will be sent to student via email or mail.
